Ownership
of Merchandise
All goods become your
property at the time they are accepted from the carrier.
Order Acknowledgement
When you submit an
online or telephone order this implies conditional acceptance by Keen
Promos of your offer to purchase goods and is your acceptance of Keen
Promo's terms and conditions. You and Keen Promos agree that any contract
hereby entered into has been made and is to be construed to Ohio State
Law.
Terms of Payment
If you are granted
payment terms by Keen Promos, you agree that your past due invoices will
be assessed a 1.5% finance charge. You agree to pay all the company's
reasonable attorney's fees and all collection agency fees incurred while
collection of past invoices is conducted.
Non Sufficient
Funds
In all cases where
a check is returned for Non Sufficient Funds we will assess a $40.00 fee
to the issuer of the check.
Shipping Delays
Keen Promo customers
agree that they will not hold Keen Promos responsible for delays in delivery
that are as a result of acts of God or other circumstances over which
Keen Promos has no direct control. Delivery and shipment dates estimates
and in no case will Keen Promos be liable for any consequential or special
damages resulting from any delay in delivery.
Warranties
Keen Promos warrants
that goods sold on our web site are made available to you with any warranty
from the manufacturer of the good(s) you purchase.
Sales Tax
Keen Promos is required
by law to collect all applicable sales taxes for the state, counties and
cities of Ohio. Tax exempt organizations, companies, and individuals should
provide Keen Promos with their Tax Exempt certificate.
Cancellations
and Alterations to Existing Orders
Once an order is approved,
we cannot guarantee our ability to make changes or cancellations to an
it. Although Keen Promos will make every effort to comply with your cancellation
request, a charge may be accessed in order to process the cancellation
of your order. Likewise, you are liable to pay for any work that may have
been completed up to the time that your order is cancelled. All completed
work and costs incurred will be the responsibility of the customer.
Over/Under
Run Policy
Although we try our
best to produce exactly the quantity of product you order, because high-speed
machinery is used to imprint your artwork and text onto the products you
order, it is difficult to shut down an imprinting machine at precisely
the moment your ordered quantity is reached. Consequently, your order
may contain slightly more or less product than you originally ordered.
Keen Promos will credit or charge your account up to 10% for over/under
runs.
Prices &
Information on our Web Site
Although the Keen
Promos web site is continuously updated to provide customers with current
information and pricing, occasionally changes in information and pricing
from our manufacturers is not immediately available on the web site. Keen
Promos reserves the right to change prices on our web site at anytime.
In the event that you purchase an item that is listed with an outdated
price, we will contact you immediately to inform you of the change.
Minimum
Order Quantity with Imprint
All products listed
on the Keen Promos web site indicate the minimum quantity required for
an imprint. This minimum is set by our manufacturers and is required if
imprinting is desired. In many cases, "Less Than Minimum" quantities
can be ordered with an imprint for an additional charge. Less Than Minimum
is typically one-half of the indicated minimum quantity. Unimprinted items
can typically be ordered in any quantity.
